FACTS. - Occidental attempted to foreclose a trust deed on the Mehr's property but with procedural nonconformities, including sending notice of sale only two months after amended notice of default. Occidental was the only bidder and the purchaser at a trustee's sale in December 1985, but then it rescheduled the trustee's sale after correcting the defects and again purchased the property at a trustee's sale in April 1986. PROCEEDINGS. - Occidental sued for a deficiency based on the April sale. The district court held against Occidental and upheld the December sale. Occidental appealed.
